Booking and payment for a fishing charter with Pro Red Fishing Charters is deemed acknowledgement and acceptance of the following conditions.

Bookings and dates will only be confirmed upon receipt of payment.

Bookings cancelled within 14 days of departure will be non-refundable and cannot be transferred or rescheduled to another date.

Failure to attend a scheduled charter without prior notice will result in the full booking fee being forfeited.

The skipper of the vessel reserves the right to cancel, postpone or transfer a charter to the next available date at any time, including the scheduled departure time, due to actual or predicted weather conditions, mechanical issues, insufficient passenger numbers, safety concerns or any other circumstance beyond the reasonable control of Pro Red Fishing Charters.

All prices for charters will be confirmed at the time of booking. Pro Red Fishing Charters reserves the right to amend advertised pricing, charter details and departure times without notice.

All anglers are responsible for ensuring they hold any current and valid fishing licences or permits required by law for the area in which the charter operates.

Passengers must arrive at the designated departure location at least 15 minutes prior to departure unless otherwise advised. The vessel will not be delayed for late arrivals and no refund will be provided for passengers who fail to arrive on time.

Passengers must not be under the influence of drugs or excessive alcohol prior to or during the charter. The skipper reserves the right to refuse boarding or terminate a passenger's participation where safety may be compromised. No refund will be provided in such circumstances.

Passengers are responsible for advising Pro Red Fishing Charters prior to departure of any medical condition, injury or physical limitation that may affect their ability to safely participate in the charter.

Children under 18 years of age must be accompanied by a parent or legal guardian unless otherwise agreed in writing.

DISCLAIMER AND LIMITATION OF LIABILITY

Booking and payment for a fishing charter with Pro Red Fishing Charters is deemed acknowledgement and acceptance of the following disclaimer.

Fishing and boating activities involve inherent risks, including but not limited to changing weather conditions, vessel movement, equipment failure, slips, trips and falls, interactions with marine wildlife and other unforeseen hazards.

To the fullest extent permitted by law, Pro Red Fishing Charters, its owners, employees, agents and contractors shall not be liable for any injury, illness, death, loss, damage, delay or expense suffered by any passenger arising from participation in a charter, except where such liability cannot be excluded by law.

Passengers participate in all activities at their own risk.

Pro Red Fishing Charters accepts no responsibility for loss of or damage to personal belongings, including fishing equipment, cameras, phones, clothing, jewellery or other valuables brought aboard the vessel.

All passengers shall comply with any lawful direction given by the skipper or crew for the safety of the vessel and comfort of passengers. Failure to comply may result in the charter being terminated for that passenger and/or an immediate return to port without refund.

Passengers agree to indemnify Pro Red Fishing Charters against any loss, damage, cost or expense arising from their deliberate, reckless or unlawful conduct.

All passengers shall be liable for any costs associated with repairs, replacement or cleaning of the vessel and/or equipment resulting from deliberate or wilful damage caused by that passenger.

Pro Red Fishing Charters reserves the right to use photographs and videos taken during charters for promotional and marketing purposes unless a passenger advises otherwise prior to departure.
